Custom Artwork, Approval & Intellectual Property Policy
Effective Date: January 2024
CA Graduation Inc. specializes in manufacturing custom graduation products for schools, universities, churches, organizations, and businesses.
Many of our custom products feature customer-provided logos, school names, university seals, artwork, graphics, embroidery, and personalized text.
This policy explains our custom production process, artwork approval requirements, and the responsibilities of both CA Graduation Inc. and our customers.
Our Role in Custom Production
CA Graduation Inc. manufactures custom products using artwork, specifications, and instructions provided or approved by our customers.
To prepare artwork for production, our team may perform technical adjustments such as:
- File formatting
- Artwork sizing
- Color adjustments
- Logo placement
- Embroidery digitizing
- Production setup
These technical services are performed solely to ensure manufacturing accuracy and do not create ownership or authorship of customer-submitted artwork.
CA Graduation Inc. does not:
- Create original customer artwork unless separately agreed
- Verify ownership of submitted artwork
- Provide legal advice regarding intellectual property
- Confirm trademark, copyright, or licensing rights
- Obtain permissions on behalf of customers
Customers are responsible for ensuring they have the necessary rights to reproduce submitted materials.
Customer Artwork Authorization
By submitting artwork or design materials, you confirm that:
- You own the artwork or have obtained the necessary permission to use it.
- You have the authority to authorize CA Graduation Inc. to manufacture products using the submitted materials.
- The submitted materials do not knowingly infringe upon the intellectual property rights of any third party.
If you place an order on behalf of a school, college, university, church, business, or other organization, you also confirm that you are authorized to act on behalf of that organization.
CA Graduation Inc. has no obligation to verify your authorization.
Customer-Supplied Materials
Customer-provided materials may include, but are not limited to:
- School or university names
- Academic seals
- Department names
- Logos
- Mascots
- Graduation marks
- Honor society names
- Organization names
- Trademarks
- Copyrighted artwork
- Graphics
- Photographs
- Signatures
- Fonts
- Text
- Colors
- Other protected intellectual property
All submitted materials remain the responsibility of the customer.
CA Graduation Inc. uses customer artwork solely for producing the authorized custom order and does not sell, distribute, or reuse customer artwork without permission.
Artwork Review & Proof Approval
Before production begins, we may provide a digital artwork proof for review.
Customers are responsible for carefully checking every detail, including:
- Spelling
- Names
- Dates
- Degree information
- School information
- Colors
- Logo accuracy
- Artwork placement
- Product specifications
- Overall design
Production begins only after written approval has been received.
Written approval may be provided by replying "APPROVED" via email or through another written approval method accepted by CA Graduation Inc.
Once approved, the artwork is considered final for production.
Production Authorization
By approving the final artwork proof, you confirm that:
- The design accurately reflects your requested artwork.
- All information has been reviewed.
- CA Graduation Inc. is authorized to manufacture the products exactly as approved.
Once production has started, changes, cancellations, or corrections may no longer be possible.
Additional charges may apply if changes are approved after production has begun.
Intellectual Property Responsibility
CA Graduation Inc. respects intellectual property rights and expects customers to submit only materials they are legally authorized to use.
CA Graduation Inc. does not determine whether submitted materials are protected by:
- Copyright
- Trademark
- Patent
- Trade dress
- Publicity rights
- Privacy rights
- Other intellectual property laws
Acceptance of artwork does not constitute legal approval, ownership verification, or confirmation that reproduction is authorized.
Customers remain solely responsible for obtaining all required permissions before submitting artwork.
Right to Refuse Orders
CA Graduation Inc. reserves the right to refuse, delay, suspend, or cancel any custom order if submitted materials appear to violate applicable laws, intellectual property rights, or our production standards.
Choosing to accept or decline an order does not create an obligation for CA Graduation Inc. to investigate ownership or licensing of submitted materials.
Customer Responsibility & Indemnification
Customers are responsible for ensuring that all submitted artwork has been properly authorized.
By placing a custom order, customers agree to indemnify and hold harmless CA Graduation Inc., including its owners, employees, affiliates, contractors, and representatives, against claims, damages, expenses, or legal costs arising from:
- Unauthorized artwork
- Trademark disputes
- Copyright claims
- Intellectual property disputes
- False claims of ownership
- Customer-provided materials or instructions
Limitation of Liability
CA Graduation Inc.'s responsibility is limited to manufacturing products according to the customer's final approved artwork.
We are not responsible for:
- Intellectual property disputes
- Unauthorized use of submitted logos or trademarks
- Errors approved during the proof process
- Customer-provided spelling, names, dates, or factual information
- Indirect, incidental, consequential, or special damages related to customer-submitted materials
Confidentiality of Customer Artwork
We understand that customer artwork represents valuable intellectual property.
Customer-provided logos, school seals, artwork, and branding materials are used solely to manufacture the customer's authorized order.
Unless authorized by the customer, CA Graduation Inc. will not publicly display, sell, distribute, or reuse customer artwork for unrelated purposes.
Governing Law
This Policy is governed by the laws of the State of New Jersey.
Any dispute arising from this Policy shall be resolved exclusively in the state or federal courts located within the State of New Jersey.
Acceptance of Terms
By placing a custom order, submitting artwork, approving a proof, or authorizing production, you acknowledge that you:
- Have read this Policy
- Understand the artwork approval process
- Have the authority to submit the provided materials
- Approve production based on the final proof
- Accept responsibility for all customer-submitted materials
